Welcome to BUZUD Online (www.buzud.com) owned and operated by Roffe International Holdings Pte Ltd. (“we”, “us”; and “Buzud”). On Buzud Online you can browse and buy products from Buzud. These Buzud Online Conditions of Use (“Conditions”) apply to your use of BUZUD Online, whether you are browsing or buying. The Conditions are in addition to the following legal terms and conditions: For the sale of Products to you by Buzud on Buzud Online, see the BUZUD Online Buyer Agreement. YOUR CONTINUED USE OF BUZUD ONLINE CONSTITUTES YOUR ACCEPTANCE OF THESE CONDITIONS. TAMPERING WITH BUZUD ONLINE, MISREPRESENTING THE IDENTITY OF A USER, USING BUYING AGENTS OR CONDUCTING FRAUDULENT ACTIVITIES ON THE SITE ARE PROHIBITED.

No Products are for sale to children and any children's Products are displayed for purchase by adults. If you are under 18 you may use BUZUD Online only with the involvement of a parent or guardian.

• Use of BUZUD Online is limited to parties that can lawfully enter into and form contracts under the laws of Singapore. You may not misuse BUZUD Online.
• You may use BUZUD Online only as permitted by applicable Regulations.
• You must not use BUZUD Online:

1.  in any way that causes, or is likely to cause, BUZUD Online, or any access to it, to be interrupted, damaged or impaired in any way;
2. for fraudulent purposes, or in connection with a criminal offence or other unlawful activity; or
3.  to cause annoyance, inconvenience or anxiety.

The licenses granted by BUZUD under these Conditions terminate if you do not comply with these Conditions and any other Applicable Terms. We reserve the
right to refuse service, terminate accounts or remove or edit content if you are in breach of applicable Regulations, these Conditions or any other Applicable
Terms.

BUZUD sells Products on BUZUD Online.

BUZUD Online is the trading name for BUZUD (Singapore) Pte. Ltd. (the “Brand Names”). The Brand Names are owned and maintained by BUZUD.
You can contact us using the Contact Us page on BUZUD Online.

BUZUD reserves the right to reject any registration and to refuse service to anyone for any reason, in its sole and absolute discretion. You must follow the instructions and provide the required information as part of the registration process for a user account. You warrant and represent to BUZUD that the information you provide during the registration process (and any notification of change of such information) is true and correct. You must notify BUZUD of any changes to your registration information immediately. If you provide false or incorrect registration information or do not notify BUZUD of changes to your registration information immediately, BUZUD reserves the right to terminate your account immediately and without notice to you.

If you sign up for a user account on BUZUD Online, as a Buyer, you are responsible for maintaining the confidentiality of your user account and password and for restricting access to your computer, and to the extent permitted by applicable Regulations you agree to accept responsibility for all activities that occur under your user account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorized manner. You are responsible for ensuring that the details you provide us with are correct and complete, and for informing us of any changes to the information you have provided. You can access and update those information you have provided us with, including your account settings, by logging in into your BUZUD Online Account.

If you choose for the Goods to be collected from BUZUD stores, please bring along these items at the time of collection:
1.     A print-out or digital copy (PDF) of your original online order confirmation email. Screen grabs will not be allowed to protect against fraudulent collection.
2.     The purchasing credit card, which should be in your name (unless otherwise permitted by us)
3.     Should you wish to authorize someone else to make the collection on your behalf, kindly print out the original online order confirmation email and indicate the authorized person’s details and your written permission to authorize him/her to collect on it. He/she should present this print-out, the credit card used for the original purchase, as well as his/her personal ID for verification in order to complete the collection.

When you use BUZUD Online or send e-mails to us, you are communicating with us electronically. We will communicate with you by e-mail or by posting notices on BUZUD Online. You consent to receive communications from us electronically and you agree that all notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, unless mandatory applicable laws specifically require a different form of communication.

The Brand Names and all content included in or made available on BUZUD Online, such as text, graphics, trademarks, logos, button icons, images, audio clips, digital downloads and data compilations is the property of BUZUD (or its content suppliers). The compilation of all content included in or made available through BUZUD Online is the exclusive property of BUZUD.

You may not extract and/or re-use the Brand Names or parts of the content of BUZUD Online without our express written consent. In particular, you may not use any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-use of any substantial parts of the content of BUZUD Online, without our express written consent. You may also not create and/or publish your own database that features substantial parts of BUZUD Online (e.g. prices and product listings) without our express written consent.

BUZUD’s trademarks (including “BUZUD” and “REimagined”) may not be used in connection with any product or service that is not BUZUD’s, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits BUZUD. All other trademarks not owned by BUZUD that appear on BUZUD Online are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by BUZUD.

Subject to your compliance with these Conditions and any other Applicable Terms, and your payment of any applicable fees, BUZUD or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of BUZUD Online.

All rights not expressly granted to you in these Conditions are reserved and retained by BUZUD or its content providers. No part of BUZUD Online, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not frame or use framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout, or form) of BUZUD without our express written consent. You may not use any meta tags or any other “hidden text” using BUZUD’s names or trademarks without our express written consent.

You and other visitors to BUZUD Online may post reviews, comments and other content, provide feedback, send electronic communications, and submit suggestions, ideas, comments, questions or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of “spam”. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. We reserve the right (but not the obligation) to remove or edit such content.

If you post content or submit material you grant: (a) BUZUD a non-exclusive, royalty-free and fully sub-licensable and transferable rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media; and (b) BUZUD, its sub-licensees and transferees the right to use the name that you submit in connection with such content, if they choose. No moral rights are assigned under this provision.

You agree that the rights you grant above are irrevocable during the entire period of protection of your intellectual property rights associated with such content and material. To the extent permitted by law, you agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content. You agree to perform all further acts necessary to perfect any of the above rights granted by you to BUZUD including the execution of deeds and documents, at our request.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is posted:

(i) the content and material is accurate; and

(ii) use of the content and material you supply does not breach any applicable policies or guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify BUZUD for all claims brought by a third party against BUZUD arising out of or in connection with the content and material you supply.

If you believe that your rights are being infringed, you may contact us at CustomerCare@Buzud.com and include the word “infringement” in the e-mail subject header.
We respond expeditiously to rights owners and their agents who communicate concerns about any alleged infringement.
Upon receipt of such a communication we may take action, including requiring you to provide additional information, or removing information or an item from BUZUD Online. All of these actions are taken without any admission as to liability and without prejudice to any rights, remedies, or defenses, all of which are expressly reserved. Furthermore, in submitting such a communication, you grant to BUZUD the right to use, reproduce, modify, adapt, publish, translate, create derivative works from, and display its content throughout the world in any media. This includes forwarding the communication to the parties involved in the provision of the allegedly infringing content. You agree to indemnify BUZUD for all claims brought by a third party against BUZUD arising out of or in connection with the communication.

GIVING FALSE, MISLEADING OR INACCURATE INFORMATION IN ANY COMMUNICATION WITH BUZUD MAY RESULT IN CIVIL AND/OR CRIMINAL LIABILITY. YOU SHOULD CONTACT A LEGAL ADVISOR IF YOU HAVE ANY QUESTIONS.

Because a very large number of products are listed and many customer reviews and comments are hosted on BUZUD Online, it is not possible for us to be aware of the contents of each product listed for sale, or each customer review or comment that is displayed. Accordingly, we operate on a “notice and action” basis. If you believe that any content on, or within a product advertised for sale on, BUZUD Online contains a defamatory statement, please contact us immediately at CustomerCare@Buzud.com and include the word “defamation” in the e-mail subject header.

GIVING FALSE, MISLEADING OR INACCURATE INFORMATION IN ANY COMMUNICATION WITH BUZUD MAY RESULT IN CIVIL AND CRIMINAL LIABILITY.

In addition to these Conditions, the following Additional BUZUD Software Terms apply to any software (including any updates or upgrades to the software and any related documentation) that we make available to you from time to time for your use in connection with BUZUD Online (the “BUZUD Software”).

17.1     Use of the BUZUD Software.
You may use BUZUD Software solely for purposes of enabling you to use and enjoy BUZUD Online as provided by BUZUD, and as permitted by the Conditions, these Additional BUZUD Software Terms and any other Applicable Terms. You may not incorporate any portion of the BUZUD Software into your own programs or compile any portion of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the BUZUD Software or otherwise assign any rights to the BUZUD Software in whole or in part. You may not use the BUZUD Software for any illegal purpose. We may cease providing any BUZUD Software and we may terminate your right to use any BUZUD Software at any time. Your rights to use the BUZUD Software will automatically terminate without notice from us if you fail to comply with any of these Software Terms, the Conditions or any other Applicable Terms. Additional third party terms contained within or distributed with certain BUZUD Software that are specifically identified in related documentation may apply to that BUZUD Software (or software incorporated with the BUZUD Software) and will govern the use of such software in the event of a conflict with these Conditions. All software used by BUZUD Online is the property of BUZUD or its software suppliers.

17.2     Use of Third Party Services.
When you use BUZUD Online, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile platform provider. Your use of these third party services may be subject to the separate policies, terms of use, and fees of these third parties.

17.3     No Reverse Engineering.
Unless explicitly permitted under applicable mandatory law, you may not, and you will not encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, the BUZUD Software, whether in whole or in part, or create any derivative works from or of the BUZUD Software.

17.4     Updates.
To keep the BUZUD Software up-to-date, we may offer automatic or manual updates at any time and without notice to you.

We will do our utmost to ensure that availability of BUZUD Online will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Also, your access to any part of BUZUD Online may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.
BUZUD will not be responsible for: (i) losses that were not caused by any breach on our part; (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure); or (iii) any indirect or consequential losses that were not foreseeable to both you and us when you commenced using BUZUD Online.
Nothing in these Conditions shall limit or exclude any liability for fraud or any other liability that cannot be lawfully limited and excluded.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your legal right to have goods sent or services provided within a reasonable time or to receive a refund if goods or services ordered cannot be supplied within a reasonable time owing to a cause beyond our reasonable control.

If you breach these terms and conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these terms and conditions.

If any provision of these Conditions is deemed unlawful, void, or for any reason unenforceable, then that provision will be deemed severable and will not affect the validity and enforceability of any remaining provisions in these Conditions.

The laws of Singapore govern these Conditions, without giving effect to any principles of conflicts of laws. Any claim or dispute relating in any way to your use of BUZUD Online shall exclusively be referred to and finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (the “SIAC Rules”). The arbitration shall be conducted in accordance with the Expedited Procedure set out in Rule 5.2 of the SIAC Rules. The seat of the arbitration is Singapore. The Tribunal shall consist of a sole arbitrator. The language of the arbitration shall be English.

BUZUD may, from time to time and in its sole discretion, amend these Conditions and any part of BUZUD Online to the extent permitted by applicable Regulations.You must regularly check these Conditions to understand the current Conditions that apply to your use of BUZUD Online.

YOUR CONTINUED USE OF BUZUD ONLINE CONSTITUTES YOUR ACCEPTANCE OF THESE CONDITIONS AND SUCH CHANGES TO THESE CONDITIONS.
